Insulation Service Agreement

  • I have read, understand and agree to all of the work areas, materials, terms and conditions of the proposal received for the above referenced project. I understand that submitting this form constitutes electronic communications. I consent to send and receive electronic communications and agree that all agreements, notices, disclosures, and other communications that are provided or received electronically via email and on this website satisfy any legal requirement that such communications be in writing. I understand that the email address and IP address for this transaction will be recorded and if the signer is not linked to the email address and IP address the sender will be committing and act of fraud.

    TERMS AND CONDITIONS:
    It is agreed by and between A+ Insulation, LLC and the authorizing party (customer and/or customer's agent) that the following provisions are made as part of this contract:

    Insurance by Contactor:
    A+ Insulation, LLC warrants that it is insured for liability resulting from injury to person(s) or property and that all employees are covered by Worker's Compensation as required by law. Certificates of coverage are available upon request.

    Scheduling/ Cancellation:
    A+ Insulation, LLC will arrive on scheduled performance date. Schedules are contingent upon weather, accidents, and other delays beyond our control, and shall not be liable for damages due to those delays. A+ Insulation, LLC requests that the authorizing party provide at least 24 hours advance notice for cancellation. If a crew has been dispatched to the job site, the customer will be assessed a mobilization fee of $200.00 for incurred expenses. Cancellation fees may apply to any notice less than 24 hour notice.

    Workmanship/Performance:
    A+ Insulation, LLC professionals are trained Master Craftsman; either certified or working under direct supervision thereof. Certification comes through organizations such as a Certainteed Product Knowledge Course or the Metropolitan Energy Center Weatherization Contractor Certification and can always be verified. All work will be performed professionally, with the appropriate tools and equipment for proper job completion. A+ Insulation, LLC will not be responsible for any sprinkler lines or plumbing lines, especially frozen pipes, as it is our recommendation that these pipes are installed within heated spaces of the building (defined as spaces to be maintained at 50 degrees Fahrenheit). A+ Insulation LLC will not be held responsible for any frozen water and plumbing pipes that burst, or cause loss of life, damage to property, or loss of use of property or any other damages.

    Safety:
    A+ Insulation, LLC warrants that all work will follow industry safety standards. The authorizing party agrees to not enter the work area during insulation operations unless authorized by the crew leader onsite.

    Additional Work:
    Any additional work or equipment required to complete the work will be addressed on-site and will be agreed upon by both parties and signed off on a work change order prior to commencing.

    Lawn & Surfaces Damage/Repair:
    A+ Insulation, LLC will attempt to minimize all disturbances to the customer's lawn and surfaces. However A+ Insulation, LLC must utilize vehicles & equipment to perform services. A+ Insulation, LLC shall not be liable for damages to landscaping, sod, plant material in the execution of its work or causes beyond their control (Examples: Cracking of paved surfaces and/or sidewalk due to weight of trucks/equipment etc.).

    Pedestrian/Vehicular Safety:
    A+ Insulation, LLC is solely responsible for pedestrian and vehicular safety control within the worksite. A+ Insulation, LLC shall provide the necessary warning devices, barricades, and ground personnel required to ensure the safety, protection and warning of pedestrian and vehicular traffic within the area.

    Licenses/Permits:
    A+ Insulation, LLC is responsible for the costs of permits, licenses, and/or bonds required to perform specified worked under this contact to comply with all applicable local state and federal codes, rules and regulations. The customer/property owner shall be responsible for obtaining and paying for necessary approval from local HOA and other governing entities.

    Insurance/Indemnity:
    A+ Insulation, LLC is insured for liability resulting from injury to persons or property, and all its employees are covered by Worker's Compensation Insurance. The parties herein agree that in no instance may the customer seek damages in excess of A+ Insulation, LLC policy liability. Further, once work is completed by A+ Insulation, LLC under this contract, owner agrees to indemnify and hold harmless A+ Insulation, LLC and its agents for any injury, loss or expense associated with work performed or in any way related to services performed with this contract.

    Completion of Contract:
    A+ Insulation, LLC agrees to do its best to meet any agreed upon performance dates, but shall not be liable in damages or otherwise for delays due to inclement weather, labor or any other cause beyond its control; nor shall the customer be relieved of completion for delays.

    Terms of Payment:
    Unless otherwise noted in this proposal, the customer agrees to pay the account in full upon completion of the work. Failure to remit full payment within the payment terms will result in a finance charge of 18.99% per year compounded monthly. Payments not received within 90 days will assess a $50 late fee and may be turned over to collections.

    Types of Payment Accepted:
    Checks, Money Orders, Cashier's Check, Visa, Master-card, Discover & American Express are all accepted.

    Returned Check Fee:
    There will be a $35.00 fee charged for all checks returned to our office for in-sufficient funds.

    Governing Laws:
    The terms and conditions of this contract shall be interpreted and governed according to the laws of the State of Kansas; venue and jurisdiction shall be limited exclusively to the District Court of Wyandotte County, Kansas.

    Notice To Owner:
    FAILURE OF THIS CONTRACTOR TO PAY THOSE PERSONS SUPPLYING MATERIAL OR SERVICES TO COMPLETE THIS CONTRACT CAN RESULT IN THE FILING OF A MECHANIC’S LIEN ON THE PROPERTY WHICH IS THE SUBJECT OF THIS CONTRACT PURSUANT TO CHAPTER 429, R.S.Mo. TO AVOID THIS RESULT YOU MAY ASK THIS CONTRACTOR FOR “LIEN WAIVERS” FROM ALL PERSONS SUPPLYING MATERIAL OR SERVICES FOR THE WORK DESCRIBED IN THIS CONTRACT. FAILURE TO SECURE LIEN WAIVERS MAY RESULT IN YOUR PAYING FOR LABOR AND

    CONSENT OF OWNER

    CONSENT IS HEREBY GIVEN FOR FILING OF MECHANIC'S LIENS BY ANY PERSON WHO SUPPLIES MATERIALS OR SERVICES FOR THE WORK DESCRIBED IN THIS CONTRACT ON THE PROPERTY ON WHICH IT IS LOCATED IF HE IS NOT PAID.
